We are currently seeking an Employment Counsel (m/f/d) Germany
Based in Dreieich, Germany
The incumbent supports the Lead Employment Counsel Germany on the full scope of his responsibilities for appr. 26 legal entities in Germany and appr. 4.600 employees. The role will also work in collaboration with the Sr Director, Employment Counsel (EMEA & APAC) on issues arising outside Germany.
In liaison with Lead Employment Counsel Germany consults HR management to avoid legal conflicts and prepares legal cases in-house in a professional manner so that involvement of external law firms can be minimized. Supports Lead Employment Counsel in counselling on projects with co-determination impact. Works closely with HR customers and Works Councils on demand of the Lead Employment Counsel Germany and the Sr. Director HR to facilitate labor law dealings on local and Germany wide level. Backs up superior in case of absence, etc. The position holder reports to the Lead Employment Counsel Germany.
Essential Job Functions and Accountabilities
Position holder is a member of the Global Employment Law Team.
In liaison with Lead Employment Counsel Germany consults international HR management across 5 Groups and 14 Divisions including Corporate on German individual employee matters- legal disputes, disciplinary actions, terminations, law suits, etc. such as commercial lease of employees, operational integration management (Betriebliches Eingliederungsmanagement) before consultation of an external law firm/ attorney.
In liaison with Lead Employment Counsel Germany consults international HR management Thermo Fisher Germany related collective issues (co-determination) before consultation of an external law firm/ attorney.
In cooperation with Lead Employment Counsel Germany supports the Sr. Director, Employment Counsel (EMEA & APAC) in counselling on employment law relevant aspects of particularly assigned projects and employee issues across EMEA (with support from outside counsel as required). The scope of this work will develop over time and may include:
Transformation & Growth Projects – e.g. involvement in legal review and support of regional business restructure projects; integration of newly acquired businesses;
Operational Excellence Initiatives – e.g. regional legal review of global policy updates and implementation support to HR; advice on regional deployment of new tools or systems;
Risk Prevention and Management – e.g., individual employee termination cases; oversight and support to employment litigation management and reporting.
Supports the German Corporate Legal Team in reviewing service contracts with special focus on fictitious self-employment or illegal lease of employees.
Consults and supports local HRDs and HRMs in liaison with Lead Employment Counsel Germany in compiling the requisite case material to either resolve the issue internally or professionally prepare the material for external legal advice including litigation management and reporting.
In liaison with Lead Employment Counsel Germany co-ordinates drafts and supports negotiations of Group/ Common Works Council agreements and counsels local HRDs and HRMs on local Works Council agreements.
In liaison with Lead Employment Counsel supports the business with the implementation of internal policies in compliance with German/ EU law and legislation.
Develops concepts to mitigate employment law risks and drafts, manages and monitors master agreements/ templates (e.g. employment contracts).
Supports Lead Employment Counsel Germany and HR to align HR strategies as well as national and international projects with HR impact with national labor law requirements (e.g. all restructuring matters such as legal requirements for redundancies, employee transfers, legal communication requirements, social plans, legal entity changes/ transfers/ closures, etc.).
In liaison with Lead Employment Counsel Germany assures regular labor law update of German HR Team on latest changes/ developments, e.g. by drafting and holding trainings and/ or drafting short opinions.
In liaison with Lead Employment Counsel Germany closely co-operates with Data Privacy Officer(s)/ Data Privacy Organization.
2nd German Bar exam (2. juristisches Staatsexamen), preferably with major in labor law.
Minimum of 5-8 years practical experience in a law firm and/ or industry
Proven international experience (e.g. Masters Degree or international internship in an English speaking country).
Experience in advising on international employment law issues in jurisdictions outside Germany will be a distinct advantage.
Ability to maintain strict confidentiality.
Ability to use a high level of tact, diplomacy, discretion and empathy/understanding in a global environment across multiple cultures.
Must possess moderate computer skills in Microsoft Office (Word, Excel, Powerpoint, Outlook).
Must possess excellent written and spoken communication skills in German and English (business fluent).
Willingness to travel 10-20%.
Ability to develop high levels of credibility and support solid and positive professional relationships with HR Team and upper management.
